NeuroThinking Institute Appeals Policy

1. Introduction
This Appeals Policy outlines the process and procedures available for you or your learner(s) to challenge decisions made by NeuroThinking Institute in relation to the outcomes of monitoring processes. These may include decisions regarding reasonable adjustments, special considerations, assessment results, or the outcomes of investigations into malpractice or maladministration.
2. Purpose
The purpose of this policy is to ensure that all appeals are handled fairly, transparently, and in a timely manner. It aims to provide a clear and accessible process for addressing grievances and ensuring that decisions are made in accordance with established policies and procedures.
3. Scope
This policy applies to:
- Learners: Individuals enrolled in courses or programs offered by NeuroThinking Institute.
- Applicants: Individuals who have applied for assessment or certification.
- Staff and Faculty: Employees or representatives of NeuroThinking Institute involved in the assessment and decision-making processes.
4. Grounds for Appeal
An appeal can be made on the following grounds:
- Errors in the Monitoring Process: Mistakes or inconsistencies in the application of reasonable adjustments, special considerations, or assessment results.
- Procedural Irregularities: Failure to follow established procedures or guidelines.
- Unfair Treatment: Perceived bias or unfairness in the decision-making process.
- New Evidence: Discovery of new evidence that was not available at the time of the original decision.
5. Appeals Process
5.1. Informal Resolution
Before submitting a formal appeal, you are encouraged to seek an informal resolution. This involves contacting the relevant department or individual responsible for the decision to discuss the issue and seek clarification or a resolution.
5.2. Formal Appeal Submission
If informal resolution is not possible or satisfactory, you may submit a formal appeal. The steps are as follows:

- Submission Period: Appeals must be submitted within 20 working days of receiving the decision being challenged.
- Format: Appeals should be submitted in writing, either by email or postal mail.
- Content: The appeal must include:
- Your Details: Name, contact information, and role (e.g., learner, applicant).
- Decision Being Challenged: A clear description of the decision or action being appealed.
- Grounds for Appeal: Specific reasons for challenging the decision.
- Supporting Evidence: Any relevant documents or evidence that support your appeal.
- Desired Outcome: What you hope to achieve through the appeal (e.g., reconsideration of a decision, reversal of a decision).
5.2.2. Appeal Review
- Initial Review: The appeal will be reviewed by an Appeals Coordinator who will assess its validity and ensure it falls within the scope of this policy.
- Formal Investigation: If the appeal is valid, an Appeals Panel will be convened to investigate the matter. The panel will consist of individuals not involved in the original decision.
- Hearing: The Appeals Panel may conduct a hearing to gather further information, including interviewing relevant parties.
- Decision: The Appeals Panel will make a decision based on the investigation and hearing. The decision will be communicated in writing within 15 working days of the conclusion of the investigation.
5.3. Appeal Outcome
- Notification: You will be notified in writing of the outcome of the appeal and the reasons for the decision.
- Further Actions: If the appeal is upheld, the Appeals Panel will recommend appropriate actions to address the issue. If the appeal is not upheld, you will be provided with information on any further recourse available.
6. Confidentiality
All appeals will be handled with strict confidentiality. Information will be shared only with those directly involved in the appeals process and will not be disclosed to unauthorized individuals.
7. Review and Amendments
This policy will be reviewed annually to ensure its effectiveness and relevance. Any changes will be communicated to all relevant parties.
